Employment Litigation

Debrai has decades of experience representing both employees and employers in employment cases before state and federal administrative agencies and courts in Illinois and many other states across the country.  He has litigated cases in virtually every area of employment law, including, but not limited to, discrimination, harassment, retaliation, Family and Medical Leave Act, whistleblower, employment contract, non-compete, and individual and class action wage and hour claims.

 

Our litigation approach is simple and consistent: to obtain the best result for our clients, we must prepare our client's case as if it were going to be tried before a jury or judge rather than preparing the case as if settlement was the primary objective. That means we form an effective litigation plan based on a rigorous factual and legal analysis of the case and we execute that plan relentlessly. We litigate to win rather than with the primary goal of reaching a settlement. That approach, we believe, is far more likely to result in a favorable settlement or jury verdict for our clients.

Severance Package Negotiation

When an employer terminates or lays off an employee, it is common for an employer to provide, and/or for an employee to seek, a severance package. At times, severance package discussions may even take place in advance of the separation of employment. 

 

Severance package terms may include continued payment of compensation for a specified period of time, health care insurance continuation at the employer's expense, preferred treatment of any stock options or other qualified or non-qualified compensation plans, outplacement services, etc.  Severance terms that benefit an employer may include a comprehensive release of claims, the employee's agreement to ensure a smooth transition with regard to duties they performed, a promise to comply with any existing post-employment obligations, among other benefits.

Employment Agreements

This means, as an example, ensuring that agreements clearly define each parties' rights and obligations and our clients' core interests are protected.
